www.sporthg.com (hereinafter, the \u201cWebsite\u201d) is owned and operated by Needful, SL, a company registered in Spain under tax identification number B-61144127, with registered tax address at C\/ Sant Galderic, 18-20, 08395 Sant Pol de Mar, Barcelona (Spain), hereinafter \u201cNeedful\u201d or \u201cwe\u201d.<\/p>\n

Requirements for purchasing at www.sporthg.com<\/strong><\/p>\n

Each purchase made on the Website creates a sales contract between you (the user) and Needful. This contract is governed by these Terms and Conditions and applies to all offers and agreements relating to sales on the Website. By purchasing, you fully accept these Terms and Conditions and confirm that you have read and understood them. Needful reserves the right to amend these Terms and Conditions at any time. Any changes will apply to sales contracts from the time they are published on the Website. You agree to review these Terms and Conditions periodically for possible changes.<\/p>\n

The basic requirements for purchasing on the Website are:<\/strong><\/p>\n

Be at least 16 years old.<\/p>\n

Be a direct consumer of the product, not a distributor.<\/p>\n

You guarantee that the information supplied in the application or order is accurate and complete.<\/p>\n

Needful does not guarantee the availability of the Website. The Website may undergo technical changes or repairs at any time, resulting in its partial or complete unavailability for as long as necessary and without prior notice. Needful accepts no liability for any potential problems, loss or damage arising from this.<\/p>\n

How to place an order<\/strong><\/p>\n

Users may browse the online store freely and add the products they want to their shopping cart. After selecting the products, the user will proceed to checkout, accept the stated prices, enter their billing details, accept the purchase Terms and Conditions and pay using an accepted and available method. The user must freely and voluntarily provide the personal data requested. This data will be processed in accordance with current data protection legislation, Regulation (EU) 2016\/679 of 27 April 2016 (GDPR), Spanish Organic Law 15\/1999 of 13 December on Personal Data Protection (LOPD) and Royal Decree 1720\/2007 implementing the LOPD, as detailed in this Website\u2019s Legal Notice and Privacy Policy.<\/p>\n

Under this legislation, you have the right to request access to, rectification, portability and erasure of your data, as well as restriction of and objection to its processing, by writing to St Galderic 18-20, 08395 St Pol de Mar, or emailing info@needful-priortite.com with the subject \u201cLOPD, ARCO Rights\u201d and attaching a copy of your identity document or another legally equivalent means of identification. You may withdraw your consent at any time without affecting the lawfulness of processing carried out before its withdrawal. You also have the right to lodge a complaint with the supervisory authority if you believe your data protection rights have been infringed (agpd.es).<\/p>\n

The purpose of this contract is to govern the sales relationship created between the provider and the user when the latter accepts these purchase conditions during the online contracting process by ticking the relevant box.<\/p>\n

The system will then send an automatic order acceptance notice to the email address supplied by the user, and Needful will arrange shipment to the address provided. Once payment has been completed and the automatic notice received, the sales contract between Needful and the user will be concluded and both parties will be bound by these Terms and Conditions.<\/p>\n

If you do not receive the automatic email notice, please contact Needful.<\/p>\n

Needful will retain a copy of the order in its system. Another copy will be sent to the confirmation email address supplied with the order. The information in that copy will be the only valid record for subsequently checking that the shipment corresponds to the order placed.<\/p>\n

Our right to reject an order<\/strong><\/p>\n

Needful reserves the right to check orders in advance and reject any order at any time without having to give a reason. Needful checks orders at random to screen transactions, verify creditworthiness and identify possible fraud. Rejection will result in a refund of the amount charged, with no right to any further compensation. A Needful team member will communicate the rejection electronically or by telephone as soon as possible.<\/p>\n

Some reasons why an order may be rejected include:<\/p>\n

The purchased product is not in stock.<\/p>\n

Your billing information is incorrect or cannot be verified.<\/p>\n

The order or user information gives rise to suspected fraud.<\/p>\n

The user does not meet the requirements of these Terms and Conditions.<\/p>\n

There is an obvious error in the stated price.<\/p>\n

There is a delivery problem because the address cannot be reached or contains spelling errors.<\/p>\n

The order is suspected of originating from an automated purchasing service or bot.<\/p>\n

Returns, exchanges and cancellations<\/strong><\/p>\n

The user may not freely cancel an order without justified cause once it has been accepted, paid for and automatically confirmed.<\/p>\n

Needful may change items in an order because of lack of stock or similar circumstances, provided it first requests and obtains the user\u2019s approval.<\/p>\n

Intimate underwear (knickers, briefs and bras) cannot be exchanged or returned.<\/p>\n

RETURN INSTRUCTIONS<\/p>\n

IMPORTANT: The entire order must always be returned, never a single product.<\/p>\n

Once the order has been received, the user may return it, if desired, subject to the following rules:<\/p>\n

To make a return, the customer must follow these steps:<\/p>\n

Access their user page through the Website and follow the electronic returns process.<\/p>\n

Pack the product securely, including all accessories, manuals and labels.<\/p>\n

Wait for the SportHG\u00ae team to arrange transport to collect the parcel.<\/p>\n

Return shipping is free, unless only part of an order is returned, in which case a charge of \u20ac2.95 will apply.<\/p>\n

Our team will review your request and confirm the return by email. Once confirmed, the carrier will collect the parcel. Collections are normally made within 24 hours of return confirmation. If you want collection from an address other than the one stated in your order, please contact us.
Once the parcel arrives at our headquarters, we will inspect it and issue the refund.
Automatic exchanges are not available. To exchange an item, you must return it and place a new order for the correct size.<\/p>\n

The return refund will be issued within 30 working days after the returned goods are received at the delivery address provided by Needful.<\/p>\n

Offers including free gifts, such as \u201cbuy 2, get 3\u201d, cannot be returned; only size exchanges are accepted.<\/p>\n

Product quality<\/strong><\/p>\n

There may be slight differences in colour and shape between photographs on the Website and the products received due to graphical variations in the images. Needful accepts no liability for such variations, as the photographs shown are not contractually binding.<\/p>\n

Needful recommends following the product care instructions to prevent deformation and problems caused by improper use. Needful accepts no liability for deformation or problems resulting from failure to follow its care recommendations.<\/p>\n

Product guarantee<\/strong><\/p>\n

Products purchased on the SportHG\u00ae website carry a two-year guarantee against manufacturing defects. This guarantee never covers product wear resulting from use.<\/p>\n

Prices<\/strong><\/p>\n

Prices shown on the Website include VAT and are stated in euros.<\/p>\n

Needful reserves the right to change prices before an order is placed, at any time and for any reason. Once the order has been placed, the displayed price is confirmed for the transaction and cannot be changed.<\/p>\n

Needful reserves the right to run occasional offers and promotions on any prices shown on the Website.<\/p>\n

Needful will add shipping costs to each order. These costs will be determined according to the user\u2019s geographical location. Needful reserves the right to offer free shipping according to the order value or for other commercial reasons.<\/p>\n

The total amount payable will include the purchase price, taxes and shipping costs and will be clearly displayed before the purchase is completed.<\/p>\n

Payment method and invoicing<\/strong><\/p>\n

Accepted payment methods are Mastercard, Visa, American Express and Maestro credit cards.<\/p>\n

Needful reserves the right to check the credit associated with each purchase in accordance with the Privacy Policy and, where appropriate, to reject the payment method following that check.<\/p>\n

Needful will issue an invoice for each transaction and send it with the order. If the user requests an electronic invoice in PDF format, Needful will provide it.<\/p>\n

Shipping<\/b>\u00a0and delivery<\/strong><\/p>\n

Shipments are sent and received from Monday to Friday, excluding national and local public holidays.<\/p>\n

We only ship orders to EU countries. To purchase from another location, please contact our customer service team.<\/p>\n

Whenever possible, we will try to ship all items in the same order together. Stock or warehousing issues may require a shipment to be split. In that event, we will contact the user to confirm whether they agree. No additional shipping costs will be charged for split shipments.<\/p>\n

Check the condition of the parcel before accepting it. Do not accept it if you notice any damage or irregularity.<\/p>\n

For administrative reasons, SportHG\u00ae accepts orders for delivery to the Canary Islands. If you wish to buy directly from a retailer in the Canary Islands, contact info@sporthg.com and we will explain the available options. We apologise for any inconvenience.<\/p>\n

Right of withdrawal<\/strong><\/p>\n

If the user is not satisfied with the products received, they may return them within 30 calendar days of receipt, clearly stating the reason for rejection, provided that:<\/p>\n

The products have not been used and\/or washed.<\/p>\n

The product is complete; for example, both items in a pair must be returned.<\/p>\n

They are returned in their complete original packaging with all labels attached.<\/p>\n

To exercise the right of withdrawal, the user must contact Needful. We will refund the payments made within 30 calendar days after receiving the items. Needful reserves the right to use a payment method other than the one originally used by the user to issue the refund.<\/p>\n

Liability<\/strong><\/p>\n

If Needful breaches the obligations set out in this document, it will be liable for loss or damage suffered by the user. Loss or damage is foreseeable if it is a direct consequence of a breach of these Terms and Conditions or if it was contemplated by Needful and the user when the contract was concluded, to the extent permitted by applicable law.<\/p>\n

Although appropriate checks have been applied to the Website, it may contain errors or incorrect or incomplete data. We accept no liability arising from use of the Website, including technological problems such as computer virus infections. Despite the considerable security measures taken, the security of information and payments made through the Website cannot be guaranteed.<\/p>\n

If loss or damage arises from a purchase on the Website, our liability will be limited to reasonable and demonstrable cases of negligence by Needful.<\/p>\n

Needful will not be liable for loss or damage involving products on which a third party has intervened or which have been altered or handled by a third party.<\/p>\n

Needful will not be liable for loss or damage caused by products that have undergone any intervention not directed by SportHG or Needful.<\/p>\n

The Website is made available for private use. End users are responsible for not using it for commercial purposes or for the benefit of third parties.<\/p>\n

Needful accepts no liability for damage caused by such websites, even where they use the SportHG image under a collaboration agreement with Needful. Needful owns all intellectual property rights in the Website and all material published on it. This includes logos, icons, trademarks, text, graphics, photographs, moving images, sound, illustrations and software, unless otherwise stated. You may use a printed copy or screenshot taken from the Website where necessary to place an order or use the Website to make purchases.<\/p>\n

Images, information or text from the Website may not be used without Needful\u2019s express consent and without properly crediting their source.<\/p>\n

Misuse of the Website<\/strong><\/p>\n

The Website may not be used for any action not expressly authorised in this document. The following non-exhaustive examples are prohibited:<\/p>\n

Using it as a basis for commercial transactions with third parties in which the user acts as an unauthorised distributor or retailer.<\/p>\n

Needful has the right to modify or delete such messages without providing justification, although it will generally follow the rules on proper and improper use of the Website set out in these Terms and Conditions.<\/p>\n

Needful acts solely as a passive channel for messages posted by users through the Website and is not responsible for their content. Needful will remove any message it considers inappropriate, including messages that breach applicable law, infringe its own or third-party intellectual property rights or involve discrimination based on gender, race, sexual orientation, social status, etc.<\/p>\n

Is over 16 years of age and has sufficient legal capacity to enter into a contract.<\/p>\n

Has read and accepts these general purchase conditions from the moment they purchase any product offered.<\/p>\n

This document may be printed and stored by users.<\/p>\n

The provider makes an email address available to users for any questions regarding these conditions.<\/p>\n

These conditions will remain valid indefinitely and will apply to all contracts concluded through the provider\u2019s website.<\/p>\n
